Essentia Funding, LLC ("Essentia," "we," "us") is a direct funder providing financing to businesses, including merchant cash advances (purchases of future receivables) and equipment financing. This Privacy Policy explains how we collect, use, and share information when you visit our website, submit an application, or otherwise interact with us.
1. Information we collect
Application information. When you or your business applies for financing, we collect business information (legal name, EIN, address, industry, time in business), owner information (name, address, date of birth, Social Security number, ownership percentage), and financial information (business bank statements, revenue and receivables data, processing statements, tax returns, and balances).
Automatic information. When you use our website we collect device and usage information such as IP address, browser type, pages viewed, and cookie identifiers.
Third-party information. With your authorization, we obtain reports from consumer and commercial credit bureaus, bank-data providers you connect, identity-verification services, and public records (including UCC filings and business registrations).
2. How we use information
We use information to verify identity and business ownership; evaluate applications and underwrite financing, including assessing your business's receivables for merchant cash advance offers; originate, service, and collect on funded transactions; detect and prevent fraud; comply with legal obligations (including anti-money-laundering rules); improve our website and services; and, with your consent where required, send you marketing about products that may interest your business. You may opt out of marketing at any time.
3. How we share information
We share information with: funding partners and participants who fund, purchase an interest in, or service your transaction; service providers who work on our behalf (identity verification, bank-data aggregation, document processing, payment processing, marketing); credit bureaus, to whom we may report application and performance information; brokers or ISOs who referred your application, limited to the status and outcome of that application; and authorities when required by law, subpoena, or to protect our rights. We do not sell your personal information.
4. Telephone and text communications
By providing a phone number, you consent to receive calls and text messages from Essentia relating to your application and account, including through automated systems. Consent to marketing calls or texts is not a condition of obtaining financing, and you may revoke it at any time by replying STOP or contacting us.
5. Security and retention
We protect information using encryption in transit and at rest, access controls, and monitoring. We retain application and transaction records as long as needed for the purposes described above and to meet legal and regulatory retention requirements.
6. Your choices and rights
You may request access to, correction of, or deletion of your personal information, subject to legal retention requirements. Residents of California and certain other states have additional rights under state privacy laws, including the right to know what personal information we collect and to non-discrimination for exercising rights. You consent to receive disclosures, agreements, and notices electronically, and to the use of electronic signatures, in connection with any application or transaction. You may request paper copies by contacting us.
4. Intellectual property and acceptable use
The site and its content are owned by Essentia or its licensors. You may not copy, scrape, reverse engineer, or interfere with the site, submit false applications, or use the site for any unlawful purpose.
5. Third-party content
Resources, guides, and calculators are provided for general information only and are not financial, legal, or tax advice. Links to third-party sites are provided for convenience; we are not responsible for their content.
6. Disclaimers and limitation of liability
The site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Essentia will not be liable for indirect, incidental, or consequential damages arising from use of the site.
7. Arbitration and class-action waiver
Any dispute arising out of these Terms or your use of the site will be resolved by binding individual arbitration, and you waive the right to participate in a class action, except where prohibited by law. Funded transactions are governed by the terms of their signed agreements.
8. Governing law; changes

Financing Disclosures
Merchant cash advance. A merchant cash advance is a purchase and sale of future receivables, not a loan. Amounts described as "payments" are deliveries of purchased receivables. Factor rates are not interest rates and cannot be directly compared to APR. Certain states (including California, New York, Utah, and Virginia) require commercial-financing cost disclosures; where required, you will receive state-mandated disclosures before signing.
Approval times. "30-minute approval" refers to the average time from submission of a complete application (including bank statements) to a credit decision during business hours. Some applications require additional review. Same-day funding depends on time of approval and your bank's processing times.

2. Accuracy of Advertised Rates and Terms
Any rates, factor rates, origination fees, or funding timelines displayed on this website or in our marketing materials are for illustrative and advertising purposes only. They represent the optimal terms available to the highest-qualified commercial applicants. Actual rates and maximum funding caps are determined on a case-by-case basis through our proprietary underwriting process, which analyzes historical business revenue, industry risk categories, and credit data.
3. Commercial Use Only Notice
Essentia Funding exclusively provides capital to active, legally registered business entities (such as Corporations, LLCs, and Partnerships). We do not offer consumer loans, personal lines of credit, or any financing intended for personal, family, or household use. Consequently, our financing agreements are governed by commercial statutes and are exempt from federal consumer protection laws like the Truth in Lending Act (TILA).

Electronic Signature Consent
Effective Date: August 20, 2026
This disclosure explains your rights when you sign a document with Essentia Funding, LLC electronically — for example an application, a partner (ISO) agreement, or a Form W-9 completed on our website. By checking the consent box presented with the document and applying your signature, you agree to the terms below.
1. Consent to do business electronically
You consent to use electronic records and electronic signatures for the transaction, and you agree that your electronic signature has the same legal effect as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN, 15 U.S.C. §7001 et seq.) and applicable state Uniform Electronic Transactions Act (UETA) provisions. Consent applies to the specific documents presented in that session, not to future transactions.
2. What we record
When you sign electronically we record, and attach to the executed document, an audit certificate showing: the signer’s name and title, the entity signed for, the email address provided, the date and time of signature in UTC, the IP address the signature was submitted from, the browser used, the time you consented to electronic records, the time you completed your review of the document, and a cryptographic hash of the document template that was signed. This record is retained with the executed document.
3. Reviewing before you sign
The complete document is displayed for review before a signature can be applied, and a signature cannot be submitted until the document has been scrolled through in full. You should read the entire document, including any schedules, addenda and exhibits, before signing.
4. Signature use
The signature you draw is applied by us to each signature block within the documents presented in that session, and to the certification block of a Form W-9 where one is included. It is not stored for reuse in any later transaction.
5. Hardware and software you need
To access and retain electronic records you need: a current version of a major web browser; an internet connection; a device with a mouse, trackpad or touchscreen to draw a signature; software able to display PDF documents; and either a printer or sufficient storage to keep a copy. If our requirements change in a way that materially limits your ability to access records, we will notify you and give you the chance to withdraw consent without penalty.
6. Paper copies and withdrawing consent
You may request a paper copy of any document you signed electronically, at no charge, and you may withdraw your consent to electronic records, by writing to admin@essentiafunding.com. Withdrawing consent does not affect the validity of documents already signed electronically. If you withdraw consent before a transaction is complete, we may not be able to complete it electronically and may require paper signatures instead.
7. Submission is an application
Signing and submitting a document through this website is your offer only. An agreement takes effect when Essentia Funding accepts it in writing. Submission does not create a partnership, an obligation to fund, or an entitlement to compensation.
