These Text Messaging Terms and Conditions ("SMS Terms") govern the text message programs operated by
Essentia Funding, LLC ("Essentia Funding," "we," "us") from
(856) 567-5318. By opting in to a program you agree to these SMS Terms and to our
Privacy Policy.
1. Programs and program description
Essentia Funding operates two separate text message programs. Each has its own opt-in; enrolling in one does not enroll you in the other.
Essentia Funding Account & Payment Texts (account notifications for existing customers): reminders of upcoming scheduled payments, returned or missed payment notices, payment confirmations, and balance updates on your existing funding agreement with Essentia Funding. These are transactional servicing messages; they contain no marketing.
Essentia Funding Marketing Texts: offers and information about Essentia Funding products, sent only to people who separately opted in to marketing texts.
2. How you opt in
Opt-in is a separate, optional, unchecked-by-default step and is never a condition of applying for, obtaining or purchasing any financing, product or service. Declining or withdrawing consent does not affect eligibility, approval, funding, pricing or account servicing. Signing an agreement or providing a phone number does not by itself opt you in.
You may opt in to a program by: (a) checking the separate box for that program and entering your mobile number on our closing page or on the "Text message and email updates" step (a public copy is at
essentiafunding.com/sms-consent.html); (b) completing and signing the Optional Consent page of your paper funding package; or (c) texting
START to (856) 567-5318 (Account & Payment Texts). When you opt in you will receive a confirmation text message.
3. Message frequency
Message frequency varies. Account & Payment Texts are recurring and are tied to your payment schedule and account activity. Marketing Texts are recurring and occasional.
4. Cost
Message and data rates may apply. Your mobile carrier may charge you for messages you receive or send according to your plan.
5. How to opt out
Reply STOP to any message to cancel and stop receiving texts from that program. You will receive one final message confirming that you have been unsubscribed, and no further messages will be sent. You may also opt out by emailing legal@essentiafunding.com or calling (856) 567-5318. Opting out of one program does not stop texts from a program you separately opted in to. Withdrawing consent does not change your agreement or the account notices we send by email.

7. Privacy
We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party; we share mobile information only with the service providers that deliver our messages, acting on our behalf, and as required by law. 8. Carriers and devices
Our programs are supported by major U.S. carriers. Carriers are not liable for any delayed or undelivered messages. Text messaging is not available on every device or plan, and you are responsible for any charges under your mobile plan. You represent that you are the owner or authorized user of the mobile number you enroll and that you will notify us if that number changes.
